...THE NEW LAW OF 24th DECEMBER 2003
Law 24th December 2003, - "Rules about security matter in winter sports: alpine and cross country ski" published in the Gazzetta Ufficiale n. 3 of 5th January 2004

Art.8 (Obligation to use the safety cap for children till 14 years of age)
1.In the alpine ski and snowboard practice is obliged for children till 14 years of age to have on the safety cap in keeping with the characteristic of subsection 3.
2.The person who violetes the disposal of subsection 1 has to pay an amministrative sanction from Euro 30,00 to Euro 150,00.
3.Within 3 months from the date of came into force of this law, the Healthy Minister and Infrasructure and Transport Minister, heard the concerned people of CONI, establish with own decree the technical characteristics of safety cap of subsection 1, and establish the type of omologation, the conformity checks of the production and appropiate controls.
4.Anyone who imports or produces for the trading safety caps not similar to the characteristics of subsection 3 has to pay an amministrative sanction from Euro 5.000,00 to Euro 100.000,00.
5.Anyone who trades safety caps not similar to the characteristics of subsection 3 has to pay an amministrative sanction from Euro 500,00 euro a 5.000,00 euro.
6.The safety caps not similar to the characteristics prescribed are subjected to impoundment from legal authority.
7.Disposals of subsection 1,2,4,5 and 6 are applied from 1st January 2005.

Art. 9 (Speed)
1.Skiers have to keep a conduct, that in relation to the ski runs characteristics and to the enviroment situation, do not be a danger for the other people's safety.
2.Speed has to be moderate in the ski runs with not enough visual, near prefabricated or obstacles, in the crossings, in the forks, in case of fog, low visibility or crowding, in the bottlenek and in presence of beginners.

Art. 10 (Priority)
1.The upstream's skier has to keep a direction which allows him to avoid collisions or interferences with the downstream's skier.

Art. 11 (Overtaking)
1.Skier who wants to overtake another skier has to be sure to have sufficient space for his purpose and to have sufficient visibility.
2. Overtaking can be effected both upstream and downstream, on rights and on links keeping at a certain distance in order to avoid hitches to the overtaken skier.

Art. 12 (Crossing)
1.In the crossing skiers have to give the priority to who come from right or in accordance with the indications.

Art. 13 (Waiting)
1.Skiers must wait at the ski runs' sides in order to avoid dangers to other skiers.
2.Skiers have not to stop at the obliged passages, near rices or in places with low visibility.
3.In case of falls or accidents, the skiers must go at the ski runs's sides.
4.Anyone must inform a qualified person with adequate signals about the presence of an injured person.

Art. 14 (Failure to stop and give assistance)
1.In all cases not included into the second subsection of the art. 593 of penal code, anyone during ski practice or during other snow sports, who find a person in difficulty and he does not stop and give assistance, i.e. he does not inform immediately the manager, by any call station, about the accident occurred, is subject to pay an amministrative sanction from Euro 250,00 to 1.000,00 euro.

Art. 15 (Transit and ascent)
1.Is not allowed walking on ski runs, a part cases of urgent need.
2.Anyone who goes down ski slopes without ski must walk at slope's sides, in according to art. 16, subsection 3.
3.In case of competions is not allowed to strangers overtake the limites signaled, waiting or walking on the competition's ski runs.
4.Ascent ski runs without ski is usually not allowed. It is allowed only with a previous authorization, in case of urgent need, and however it must happen at ski runs' sides, having care to avoid risks for skiers' safety in accordance to the present law's rule, and to regulation of the manager of the equipped ski area.

Art. 16 (Mechanical vehicles)
1.It is not allowed to mechanical vehicles the ski run's use, a part what the present article expects.
2.The mechanical vehicles for lifts and slopes servicing and maintenance can entry only during the closing time, a part case of urgent need, and however with luminous and acustical mechanisms' use.
3.Skiers, in the case of subsection 2, have to give the priority to mechanical vehicles for lifts and run servicing and maintenance and they must permit their fast and easy circulation.

Art. 17 (Outrun ski and nordic ski)
1.The lift's dealer and manager are not responsible of accident happened along out-runs served by the same lifts.
2.People who plays nordic ski must be equipped with electronics systems, where needed, in bad weather conditions, and if exist avalanches risks in order to grant a qualified help.

Art. 18 (Further prescriptions for safety and sanctions)
1.Regions and town counsil could have further prescriptions to grant the safety and the best use of ski runs and ski lifts.
2.Regions decide the amount of amministrative sanctions to apply in case of violation of disposal of art 5, subsection 3,6, from 9 to 13 and from 15 to 17, to establish between a minimum of 20,00 euro and a maximum of 250,00 euro.

Art. 19 (Contributory negligence)
1.In case of accident between skiers, until proved otherwise, it assumes that both skiers have contribute to produce the same damages.
